| Summary, etc. | Les études au sujet de la qualité de la justice et de ses décisions sont relativement récentes : elles portent sur une notion qu’il nous paraît essentiel d’examiner de façon approfondie. Cet article se propose donc d’étudier deux types de réflexions portant sur la qualité des décisions de justice. La première analyse le discours de la doctrine, qui s’est attachée à déterminer un certain nombre de critères. La seconde adopte une approche critique sur ceux qui sont mis en place par l’État dans le cadre des réformes du service public de la justice. La comparaison des deux discours révèlera l’existence d’un décalage entre deux conceptions différentes de la qualité des décisions. En effet, l’approche choisie par les pouvoirs publics se caractérise par une logique gestionnaire et managériale qui ne se retrouve pas dans le discours tenu par la doctrine. Dès lors, il sera question de rechercher de quelle manière se traduisent ces divergences en termes de détermination de critères. |

| Summary, etc. | The Quality of Judicial Decisions: Which Criteria ?Studies on the quality of judicial decisions are relatively recent and are based on the fundamental notion needing thorough examination. Therefore, this article will put forward two areas of reflection regarding the quality of judicial decisions. The first one will analyze the discourse of the doctrine which has so far endeavored to establish a list of criteria. The second one will emphasize a critical approach concerning the standards selected by the government within the limits of a reform of the judicial system. The comparison of those two types of discourse will reveal a gap due to a difference of perceptions. They do not perceive the quality of judicial decisions in the same way. Undeniably, the option chosen by the public authorities is mainly that of an administrative and managerial logic, in opposition to the discourse of the doctrine. We will therefore focus on how those oppositions lead to different choices of criteria. |
