| Summary, etc. | RésuméLa « nature », notion plus large que celle d’environnement constitue d’abord une lecture culturelle du rapport de l’individu à son environnement. Se préoccuper d’environnement c’est aussi se préoccuper de la relation dialectique entre homme et nature, et donc de respecter les conceptions culturelles de ceux qui vivent à son contact – ce qui débouche sur le respect des identités socioculturelles. Aussi notre démarche, appliquera la méthode du « détour » : c’est en allant voir chez les autres, outre-mer, la dimension humaine et culturelle de cette problématique, que nous pouvons le mieux, de retour chez nous, concevoir la dimension complexe du préjudice environnemental et la nécessité de le réparer autrement que dans les termes classiques de notre droit de la responsabilité. | Summary, etc. | AbstractDo Environmental Damages Harm Civilization? Interdependences, Interdisciplinarity, and the Right to Environment and Sociocultural Realities“Nature” is a broader concept than the idea of environment, which represents a cultural reading of the connection established between individuals and their environment. Dealing with environment also means caring about the dialectic relationship between humans and nature, and, as a result, respecting the cultural perceptions of those who live in it. This leads to the respect of sociocultural identities. Our approach will use the “detour” method: it consists in visiting “others” in overseas French territories, and in observing the human and cultural dimension of this problematic for them. Back home, we are more skilled in perceiving the complexity of the concept of environmental harm. It is also a way to consider the necessity of redressing these harms by other means than the traditional ones offered by the law. This detour through other cultures allows us, notably, to question our concept of locus standi and our concept of redress for environmental harm.
