| Summary, etc. | Résumé Le pouvoir politique s’exerçant sur des corps et le droit étant un instrument de normalisation pour ce pouvoir, on peut constater une normalisation juridique des corps. Le droit développe ainsi, de façon implicite, un standard de la laideur, par le droit à la prise en charge par l’assurance maladie de certaines opérations de chirurgie esthétique parce que sa laideur est jugée excessive. Donc, pour l’administration, la laideur est une pathologie. De plus, dans le cadre de l’autonomie personnelle reconnue par la Cour européenne des droits de l’homme, l’individu a le droit de transformer son corps, notamment en fonction de ce qu’il estime être la beauté. On assiste ainsi à une subjectivisation de la beauté. Le corps devient alors une création de l’individu qui peut ainsi exercer des droits sur son corps. On peut alors se demander si le body artist ne possèderait pas des droits artistiques sur son corps-œuvre d’art. |

| Summary, etc. | Objective Ugliness and Subjective Beauty of the Body in French Law The state exercises its power over people and their bodies using the law as its instrument for the normalization and homogenization of the social body. Also, there is a legal normalization of bodies. The law develops an implicit standard of ugliness: the state will not say a person is ugly, but the national health insurance system will pay for plastic surgery if one’s ugliness is judged excessive. So, for the administration, the ugliness is classified a pathology. Additionally, the European Court for Human Rights proclaims the right to the free development of personality. This right includes the right to use your body as you want, to transform it into beauty, contingent upon your estimation of beauty. Thus, the beauty is subjectivized. The body becomes a personal creation subject to the exercise of one’s rights. Does the body artist thus enjoy artistic rights to his body artwork? |
