| Summary, etc. | La surpopulation pénitentiaire, résultant de choix politiques spécifiques, est située au carrefour de l’exercice de pouvoirs décisionnels distincts émanant d’une part, des acteurs du monde judiciaire et d’autre part de l’administration pénitentiaire, c’est-à-dire de professionnels dont les logiques d’action s’avèrent parfois très divergentes. À partir d’une analyse des modalités de prise en charge de la population carcérale propres à ces deux instances (les exemples sont principalement tirés du terrain belge) et de leurs fondements normatifs et pratiques, il sera question d’identifier les points de convergence ou de tension qui, précisément, expliquent en partie la difficulté d’enrayer l’inflation pénitentiaire que l’on connait actuellement dans nombre de pays occidentaux. |

| Summary, etc. | The Management of Prison Overcrowding : Political, Administrative and Legal PerspectivesPrison overcrowding, resulting from specific policy choices, remains at the intersection of different decision-making powers : judges, sentence enforcement workers, and prison government services. While they all have to manage the position of inmates in and out of prison, their logics can be extremely divergent. However, they work together on the same situations and help to regulate “flow” and “stock” of inmates. Starting from an analysis of the way this different authorities deals with prison population (the examples are mainly Belgian), this article identifies their normative references and their diverse logics which, precisely, partly explain the difficulty in curbing prison overcrowding in many Western countries. |
