| Summary, etc. | Àpartir du système pénal belge, nous proposons d’examiner six mutations significatives: la définition de la peine est plus difficile que jamais à produire (1) et les peines et mesures pénales se diversifient (2), phénomène auquel s’associe l’hétérogénéité croissante de leurs objectifs (3). Sur un plan procédural, des mouvements de (dé)judiciarisation et de juridicisation (4), conjoints à la diversification des peines, favorisent une tendance à la contractualisation (5) et à la privatisation (6) de l’intervention pénale. |

| Summary, etc. | Starting from the Belgian criminal justice system, we propose to examine six important transformations: defining the penal sanction is more difficult than ever (1) and sanctions and measures are increasingly diverse (2), a feature which also leads to an increasing diversity of the penal aims (3). At the procedural level, trends in (de)judicialisation and juridicalisation (4), combined with the diversification of the sanctions, favours the contractualisation (5) and the privatisation (6) of the penal intervention. |

| Summary, etc. | A partir de un análisis del sistema penal belga, los autores se proponen examinar seis cambios significativos: Definir la sanción penal se hace cada vez más difícil (1) y las penas y medidas se diversifican (2);al mismo tiempo, este fenómeno está asociado a una heterogeneidad creciente de los objetivos de esas sanciones (3). Desde el punto de vista del procedimiento, unos movimientos de (des-)judicialización y judicialización (4), paralelos a la diversificación de las penas, favorecen una tendencia a la contractualización (5) y a la privatización (6) de la intervención penal. |

| Summary, etc. | Ausgehend von belgischen Kriminalsystem werden sechs zentrale Transformationen diskutiert: Die Definition von Strafen ist schwieriger geworden (1) und die Strafen bzw. die mit ihnen verbundenen Interventionen sind diversifizierter geworden (2). Dies geht einher mit einer wachsenden Heterogenität der Strafziele (3). Auf der prozeduralen Ebene zeigt sich eine widersprüchliche Bewegung von Entrechtlichung und Verrechtlichung (4), in Zusammenhang mit einer Tendenz zur Favorisierung von Verträgen (5) sowie einer Privatisierung strafrechtlicher Interventionen (6). |
