Encore faut-il leur permettre d?acquérir une véritable maîtrise sur le lieu de vie, ce qui implique une certaine capacité de choix et un pouvoir de gestion dans le rapport à l'habitat. N?affectionnant rien tant que les concepts tranchés et les notions clairement identifiables, notre droit occidental, frappé au coin de la rationalité cartésienne, ne prise pas volontiers cette idée évanescente (mais ô combien féconde) de maîtrise. D?où la difficulté de repérer dans notre catalogue juridique les occurrences de cette maîtrise. |
