Summary, etc. | Les catégories classiques de la théorie de l’État de facture juridique utilisées pour rendre compte des phénomènes fédératifs conservent un intérêt heuristique pour décrire les différentes logiques normatives qui sous-tendent les structures des États et les organisations les plus intégrées qu’ils génèrent, à condition que ne soient pas rejetés à titre d’anomalies les dispositifs résultant de dynamiques de recomposition territoriale. Celles-ci invitent à intégrer dans ces catégories la distinction entre unicité et pluralité nationales. D’une part, le droit constitutionnel de plusieurs États confrontés aux demandes de nations infra-étatiques consacre, à des degrés divers, des mécanismes traduisant en droit le caractère plurinational de ces États. D’autre part, la notion de « Fédération plurinationale » paraît la plus appropriée pour appréhender la nature juridique de l’Union européenne. |

Summary, etc. | The classical categories of the theory of the State used to legally understand federal systems retain heuristic value for interest to describe the various normative logics that underlie the State structure and the most integrated supra-State organizations, as long as the mechanisms resulting from processes of territorial recomposition are not discarded as anomalies. These dynamics lead one to distinguish, in these categories, between nation States and plurinational States. On the one hand, several states facing demands from sub-State national groups have inserted mechanisms in their constitutional laws that echo their plurinational nature. On the other hand, the concept of “Plurinational Federation” seems to be the most appropriate to grasp the legal nature of the European Union. |
