| Summary, etc. | Résumé Il existe une « tradition de l'extraordinaire dans la justice ordinaire » qui traverse tous les régimes politiques. Il s'agit, d'une part, de la marginalisation des cours d'assises et de la compétence des tribunaux de droit commun occupés par les magistrats professionnels ; celle-ci est toujours encadrée par l'exécutif et les « autorités administratives » chargées en première ligne du maintien de l'ordre. Cette tradition comporte, d'autre part, l'interventionnisme croissant des tribunaux militaires dans la défense intérieure de l'État et le recours à différentes formes de juridiction d'exception. |

| Summary, etc. | There is a "tradition of the extraordinary in ordinary justice" which has survived all political regimes. There has been a marginalisation of the Assize Courts and of the competence of the common-law courts occupied by professional judges ; this competence is still controlled by the executive and the "administrative authorities" responsible for the upkeep of order. This tradition also includes the growing interventionism by military tribunals in domestic defence of the State, and recourse to various forms of special courts. |
