| Summary, etc. | Sur la base de textes constitutionnels, la doctrine allemande a dégagé les objectifs fondamentaux auxquels répond l'exigence de motiver les jugements pénaux. Les formes que doit revêtir cette motivation et les cas dans lesquels elle peut être allégée sont prescrits de manière très précise par le code de procédure pénale allemand, que complète une pratique judiciaire qui a été systématisée. Certaines de ces règles, et notamment celles relatives à la motivation orale contrastent avec les obligations qui s'imposent au juge français. |

| Summary, etc. | On the basis of constitutional texts, German doctrine has produced fundamental objectives that are met by the requirement to explain the reasons why a criminal verdict has been reached. The forms that this explanation must take and the cases in which it can be reduced are described in detail by the German Code of Criminal Procedure, which complements a systematised judicial practice. Some of these rules, in particular those relating to oral reasoning, contrast with the requirements French judges must adhere to. |
