Summary, etc. | À l’occasion des 10 ans de la loi de 2005 sur le handicap, de nombreuses publications ont paru afin de montrer comment cette loi a été appliquée ou non et, de façon générale, quels en ont été les effets. Le propos de cet article n’est pas de dresser un nouveau bilan d’application de la loi, mais de revenir sur les circonstances qui ont présidé à son élaboration – ces circonstances sont d’ordre national (volonté politique, action des associations spécialisées ou non), mais également d’ordre européen, voire international. L’article revient également sur les étapes préparatoires, puis les débats qui ont conduit à son vote. Cette loi prise en charge pour une part par le Ministère de l’Éducation nationale s’inscrit à la fois dans la continuité de la loi fondatrice de 1975 et en même temps entend scolariser le plus possible les apprentissages des enfants concernés par des difficultés de toute nature : c’est à la société de s’adapter et donc, en l’espèce à l’école, et non l’inverse. Cet article prend appui sur des rapports parlementaires, des archives du Ministère de l’Éducation nationale ainsi que des rapports officiels. |

Summary, etc. | The 10th anniversary of the 2005 law regarding handicaps has led to a number of publications showing how it has been applied, or not, and in a general way, what its effects have been. This paper does not aim to assess the law’s application yet again but to revisit the circumstances of its elaboration. These circumstances are national (political will and the agency of charities and non-profits dedicated or not to the issue) but also European, international even. The paper also revisits the preparation of the law as well as the debates prior to its being voted upon. The law, whose responsibility is partly that of the Ministry of Education, both continues the spirit of the law of 1975 but also intends to place as much as possible of these children’s learning within the bounds of the schools, whatever their difficulties: it is up to society and in this case the schools to adapt and not the opposite. This paper makes use of Parliamentary reports, Ministry of Education archives and official reports on these issues. |
