| Summary, etc. | Dans une société désertée par la morale et la religion, le juge est régulièrement conduit à trancher des questions politiques et sociales qui invitent à s'interroger sur la fiction juridique de sa neutralité axiologique. En effet, à ce juge prétendument « bouche de la loi », on demande de prendre parti, fût-ce sous couvert d'une rhétorique d'apparence neutre – celle du droit. Comment concilier la figure abstraite du juge – celle d'un tiers impartial, situé au-dessus de la mêlée – et son incarnation dans un être de chair et de sang, traversé par ses passions, ses préjugés et sa vision du monde ? Certaines analyses, extérieures à la doctrine juridique, ont tenté d'appréhender les rapports complexes entre le mythe de l'impartialité et la réalité des rapports du juge aux valeurs (sociologie du droit et de la justice, théories du droit dites réalistes). Toutefois, au-delà de ces discours savants, le cinéma a également exploré, avec ses moyens propres, cette question de l'articulation entre la mission du juge, ses opinions personnelles, le cas échéant éclairées par le contexte social, et les conflits de valeurs auxquels il se trouve confronté dans le prétoire, en nous offrant plusieurs figures de juges français, qu'il s'agisse du juge du siège ou du parquet. |

| Summary, etc. | In a society deserted by morality and religion, the judge is regularly called upon to make decisions on political and social issues, which invite one to reflect on the legal fiction of the judge's axiological neutrality. Indeed, this judge, who supposedly represents the "mouth of the law", is asked to take sides, even if it is under cover of an apparently neutral form of rhetoric - that of the law. How can the abstract figure of the judge – that of an impartial third party, above the fray – be reconciled with their flesh-and-blood incarnation, with their own passions, prejudices and world view? Certain analyses, outside of legal opinion, have attempted to address the complex relations between the myth of impartiality and the reality of the judge's take on values (sociology of the law and justice, so-called realist theories of law). At the same time, outside of all learned discussion, film has also explored, with its own specific means, this issue of the articulation between the judge's mission, their personal opinions, where appropriate informed by the social context, and the value-based conflicts they find themselves confronted with in the courtroom, in a number of films featuring French judges and prosecutors. |
