Les citoyens n'hésitent plus à se tourner vers les cours suprêmes pour obtenir la satisfaction d'une série de revendications. En identifiant les enjeux liés à la judiciarisation de nos systèmes politiques et sociaux dans une perspective européenne, cet article identifie les fonctions politiques des juges des cours suprêmes, tout en analysant les fondements légitimes de leurs décisions. En proposant une « commune justice », cet article propose surtout de faire se rencontrer les intérêts individuels des citoyens avec l'intérêt collectif, à travers une culture de droit partagée. |

| Summary, etc. | The litigious society we live in is a reflection of an individualistic legal culture. Citizens no longer have any hesitation in turning to supreme courts to obtain satisfaction in a range of disputes. By identifying the stakes involved in judicialising our political and social systems from a European perspective, this article identifies the political functions of supreme court judges, whilst analysing the legitimate bases for their decisions. By proposing a "common justice", this article proposes above all to bring citizens' individual interests into line with the collective interest, through a shared legal culture. |
