| Summary, etc. | La Constitution d'octobre 1958 prévoit un modèle mixte d'administration de la justice judiciaire. Les pouvoirs d'organisation des services, d'équipement des juridictions, d'administration de l'instance, sont attribués au ministre de la Justice, garant de l'unité administrative de l'organisation judiciaire. Les codes de procédures et de l'organisation judiciaire déconcentrent ces « mesures d'administration judiciaire » aux chefs de cour et de juridiction. L'article illustre la pratique contemporaine des magistrats dans deux de ces domaines ministériels, notamment en temps de crise sanitaire. Il identifie, à travers une approche comparée des systèmes judiciaires, ce qui sépare la dépendance hiérarchique des magistrats dans l'organisation générale interne de leur tribunal, de leur indépendance juridictionnelle. |

| Summary, etc. | The French Constitution of October 1958 provides for a mixed model of administration of justice through the court system. The powers to organise departments, provide the courts with material resources, and administer the courts are given to the Minister of Justice, who is the guarantor of the administrative unity of the judicial organisation. The codes of procedure and judicial organization devolve these "judicial administration measures" to the heads of the courts and jurisdictions. The article illustrates the contemporary practice of judges and prosecutors in two of these ministerial areas, notably with examples from the public health crisis. Based on a comparison of judicial systems, It identifies the points that separate the hierarchical dependency of the judiciary on their general internal organisation and their adjudicatory independence. |
