| Summary, etc. | Initiating Administrative Liability in Cases of Sexual Abuse in the Church?The question of the State's administrative responsibility for sexual abuse committed within the Church is a perplexing one. How can the French State, since the 1905 Law of Separation [of the State and religious organisations], be held liable for acts committed within the religious sphere? Borderline cases do exist, in which this liability can be considered, albeit not without difficulty: these concern members of the clergy in Alsace-Moselle, where the “Concordat” regime [preceding the 1905 Law of Separation] still applies, and chaplains who officiate in public services. Far from a caricatured conception of the separation of Church and State, what is emerging is an intermingling of State and ecclesiastical responsibilities. |

| Summary, etc. | La question de l'engagement de la responsabilité administrative de l'État concernant des abus sexuels commis au sein de l'Église laisse a priori perplexe. Comment l'État, depuis la loi de Séparation de 1905, pourrait-il être tenu pour responsable des actes commis au sein de la sphère religieuse ? Il existe pourtant des cas limites qui permettent de penser – non sans difficulté – cette responsabilité : celui des ministres du culte de l'Alsace-Moselle, laquelle se trouve encore sous régime concordataire, et celui des aumôniers qui officient dans les services publics. Loin d'une conception caricaturale de la séparation des Églises et de l'État, c'est un entremêlement des responsabilités étatique et ecclésiastique qui se dessine. |
