| Summary, etc. | RésuméL’économie des contrats a renouvelé l’approche économique standard de la relation d’emploi en introduisant les notions de « hiérarchie » et de « pouvoir », éludant toutefois la distinction, classique chez Max Weber, entre « autorité » et « pouvoir ». La dimension de légitimité est évacuée – ou rationalisée –, ce qui appauvrit grandement les analyses contractualistes. S’inspirant de l’économie des conventions, cet article vise à montrer l’intérêt de la prise en compte de cette distinction. Elle apporte un enrichissement de l’analyse de la relation d’emploi et une heuristique des évolutions actuelles, considérées en termes de « désinstitutionnalisation » de l’autorité.Classification du JEL : B52, J01, J50 |

| Summary, etc. | Distinguishing authority from power through legitimacyThe “Economics of Contracts” has altered the economic analysis of the employment relationship by tackling it through sets of problems centred on “hierarchy” and “power”. However, such a presentation eludes the content of non-economic works such as Max Weber’s classical ones on the need to distinguish “authority” and “power”. So, the dimension of legitimacy is brushed aside or rationalized which greatly weakens these “contractualist” approaches. Within a framework inspired by the French Theory of Conventions, this paper aims at emphasizing the interest of taking such a distinction into account. |
