| Summary, etc. | Dans le cadre de réflexions sur le droit à l’Etat, il est possible de s’interroger sur l’existence d’un droit au territoire, corollaire du premier. La réponse à cette interrogation s’avère plutôt négative, qu’il s’agisse aussi bien de la reconnaissance d’un nouveau territoire, que du maintien d’un territoire existant. Néanmoins, l’analyse montre que les choses sont moins évidentes qu’il n’y paraît. D’un côté, d’un point de vue strictement juridique, s’il existe des limites fixées par la Constitution et par la loi, celles-ci se révèlent largement contingentes. De l’autre côté, d’un point de vue sociopolitique, le droit au territoire semble découler d’une réalité, celle d’une multiplication de territoires, dont l’identité et l’autonomie ne cessent de se renforcer. |

| Summary, etc. | In the frame of the reflections around the Right of the State, it is possible to challenge the existence of a Right to the Territory, linked to the first one. The answer to this question turns out to be rather negative, whether it concerns the recognition of a new territory, or the maintenance of an existing territory. Nevertheless, the analysis shows that things are less obvious than it seems. On the one hand, from a strictly legal point of view, if there are limits set by the Constitution and the law, they are largely contingent. On the other hand, from a sociopolitical point of view, the right to territory seems to stem from a reality, that of a multiplication of territories whose identity and autonomy are constantly strengthening. |
