| Summary, etc. | Dans le § xxx des Délits et des peines, Beccaria aborde le problème du temps judiciaire : non seulement celui de la procédure pénale, mais aussi celui de la prescription des infractions. Afin de combattre l’arbitraire, il élabore un modèle mathématique pouvant servir de règle pour déterminer ces durées par la loi. Cette analyse le conduit toutefois au constat d’un saut qualitatif – et non quantitatif – entre deux classes d’infractions : les atteintes aux biens et les atteintes aux personnes. L’anthropologie prend alors le relais de l’arithmétique pour justifier cette solution de continuité entre le droit à la vie – qui relève du « droit de nature » – et le droit de propriété – qui relève d’un « droit de société ». |

| Summary, etc. | In Chapter xxx of Des Délits et des peines, Beccaria broaches the issue of judiciary time: not only that of penal procedure but also that of the prescription of crime. In order to fight against arbitrariness, he puts forward a mathematical model which may serve as a standard to determine these durations by law. This analysis leads him, nevertheless, to a qualitative (but not quantitative) leap between two types of offenses: the damage to property and the damage to persons. Anthropology then takes over from arithmetics when it comes to justifying this solution of continuity between the right to live (which relates to natural rights) and the right to property (which relates to societal rights). |
