| Summary, etc. | L’article explore les conditions asymétriques qu’impose l’institution judiciaire aux différentes catégories de justiciables pour faire valoir leurs droits et demandes face à elle. Il s’appuie pour cela sur une enquête statistique et ethnographique sur le contentieux des expulsions locatives, et met en lumière l’effet différentiel de trois pratiques de défense des locataires assigné·e·s au tribunal sur la décision du ou de la juge : l’effet significatif de la présence à l’audience et de celui de l’accompagnement social des ménages endettés, qui contraste avec l’absence d’effet significatif de leur recours à un·e avocat·e sur le délibéré du magistrat. À travers l’étude des contraintes spécifiques pesant sur la défense des locataires en procédure d’expulsion, l’article articule l’analyse des inégalités d’usages de la justice et des inégalités de traitement judiciaire, et interroge les conditions particulières dans lesquelles des ménages pauvres peuvent être – ou non – reconnus comme des sujets de droit. |

| Summary, etc. | The article explores the specific and asymmetrical conditions imposed by judges on various categories of litigants in order to assert their rights and claims in court. Based on a statistical and ethnographic survey of the litigation of evictions, the study highlights the differential yield of three forms of judicial strategies developed by indebted tenants assigned to the court: the significant effect of the presence at the hearing, the social support of indebted households on the judge’s decision to pronounce or suspend the eviction, and, contrastingly, the absence of effect upon recourse to a lawyer. Through the analysis of the restricted conditions of tenants’ defense in eviction courts, the article describes the specific conditions under which poor households can – or cannot – be fully recognized as subjects of rights. |
