| Summary, etc. | Résumé La préoccupation spécifique pour le thème des droits de l’homme n’est pas à l’origine de la pensée de Michel Villey. De plus, ce dernier a situé la problématique dans un contexte historique dont le point de départ choisi, la pensée de Locke, n’est pas sans poser un certain nombre de questions. Enfin, sa position est ouvertement trop proche d’une hiérarchie ecclésiastique qui, historiquement, a opposé la Contre-Réforme au développement de la conception moderne des droits de l’homme. Fixé sur le modèle aristotélicien thomiste, il nie les changements intervenus avec la Modernité. La nouvelle économie monétaire et de marché, l’hégémonie de la bourgeoisie ont entraîné des acquis indéniables : une conception moderne de l’État et du droit, la culture du sujet, le développement consécutif de l’individualisme, du rationalisme, de la laïcité, la montée du positivisme juridique. Dans ce contexte, les droits de l’homme s’avèrent incontournables. Pourtant, Michel Villey n’en a pas voulu. |

| Summary, etc. | Abstract Michel Villey and Human RightsOriginally, Michel Villey was not concerned with human rights as a specific topic. Moreover, he situated his problematic in a historical context rooted in John Locke’s thinking, which raises a number of issues. In the event, his position is blatantly too close to an ecclesiastic hierarchy that historically pitted the Counter Reformation against the development of the modern conception of human rights. Focusing on the Thomist-Aristotelian model, he denied the changes brought about by Modernity. The hegemony of the bourgeoisie and the new monetary and market economy provided undeniable gains: a modern conception of the State and of law; the culture of the subject; the development of individualism, rationalism, and secularism; and the rise of legal positivism. In this context, human rights could not be ignored. Nor was it Michel Villey’s intention to do so. |
