| Summary, etc. | Résumé Depuis 2002, six textes de loi ont modifié l’ordonnance pénale du 2 février 1945 qui, en France, régit le fonctionnement de la justice pénale des mineurs et, en avril 2008, une commission a été installée par la garde des Sceaux pour, à nouveau, remodeler ce texte. Pour quelles raisons une majorité politique stable bouleverse-t-elle à un tel rythme une législation très spécifique ? Y-a-t-il une particularité française en termes de position sociale des jeunes, de délinquance et de traitement judiciaire ? Pourquoi le pouvoir politique actuel souhaite-t-il, en contradiction avec les principaux traités internationaux signés par la France, aligner le traitement judiciaire des mineurs sur celui des majeurs pénaux ? En resituant ces interrogations dans une perspective socio-historique, cet article tente de répondre à ces différentes questions. |

Forecasting the End of a Penal Law for MinorsSince 2002, six legislative acts have modified the French "ordonnance pénale du 2 février 1945," which organizes juvenile criminal law. In April 2008, a commission under the authority of the Minister of Justice was appointed to change this law again. Why does the same political majority seek change so frequently ? Is there French exceptionalism in the social position, delinquency, and legal treatment of minors? Why, contrary to international treaties it has signed, does the political majority try to treat minors and adults equally? This article seeks answers from a socio-historical perspective. |
