Summary, etc. | Cet article montre l’importance de la naissance du multiculturalisme pour analyser le débat entre H.L.A. Hart et le juge Patrick Devlin dans l’Angleterre des années 1960. Hart critique une « thèse de la désintégration » de Devlin sociologiquement naïve. Or, Devlin ne s’inquiète pas des dangers abstraits de la désintégration sociale, mais du sort de la culture juridique libérale particulière de la Grande-Bretagne au regard de l’immigration de masse des années 1950. À la différence du Continent, libertés et tradition juridique ne s’opposent pas outre-Manche. Or, cette tradition repose sur certains standards juridiques, dont l’« homme ordinaire », qui peut sembler pour un temps mis en cause par les transformations sociales. Plus qu’une opposition entre un camp libéral et un camp conservateur, ce débat met en conflit deux conceptions de la liberté, et rend compte d’une profonde crise culturelle que traverse la pensée juridique britannique au lendemain de la guerre. |

Summary, etc. | This article shows the importance of the early formation of British multiculturalism as a crucial backdrop for understanding the Hart-Devlin debate of the 1960s. Hart criticized Devlin’s “disintegration thesis,” showing that it fails sociologically. However, Devlin’s position does not focus on the abstract dangers of social disintegration, but is concerned, rather, with specific aspects of the British legal tradition. Contrary to other European cultures, liberty, and tradition are not opposed in common law culture. British liberalism relies on certain legal standards, such as the “ordinary Englishman,” which seemed challenged in the face of mass immigration during the late 1950s. Rather than a confrontation between liberal and conservative camps, the Hart-Devlin debate reveals two conflicting notions of liberty, and a profound crisis in post-war British legal culture. |
