| Summary, etc. | À travers les usages politiques de la forme procès par les membres de la Gauche prolétarienne au début des années 1970, cet article interroge les liens entre mimétisme judiciaire et justice populaire. Il met en évidence la difficile dialectique entre lutte anti-judiciaire et appel à la justice du peuple, et analyse le caractère indépassable du procès pour les opposants réprimés. Plus généralement, en se focalisant sur les récupérations militantes de l’appareil juridictionnel existant (les procès politiques et les tribunaux populaires), il s’agit ici de rendre compte de la fascination exercée par la Justice sur ceux qui veulent se réapproprier le monopole de la violence physique étatique, et l’utiliser pour punir ceux épargnés par la loi et, au-delà, créer un nouvel État. |

| Summary, etc. | This article analyzes the political uses of the form “trial” by members of the Proletarian Left [ Gauche prolétarienne] in the beginning of the 1970s, and questions the relationship between judicial mimicry and popular justice. It unveils the difficult dialectic with which this political organization, caught between anti-judicial struggles and calls for popular justice, has to deal. It shows that the form “trial” cannot be transcended by prosecuted activists, in particular. Focus on these activist uses of the judicial system (“political trials” and “popular courts”) allows us to understand that state justice remains a source of fascination for those who contest the state monopoly over legitimate physical violence and who claim the right to use violence to punish those who are beyond the law, to create a new state. |
