| Summary, etc. | Depuis les années 1990, des initiatives internationales ont concouru à forger les normes pénales de blanchiment d’argent et de corruption d’agents publics étrangers. Cette offensive nouvelle contre la criminalité transnationale s’explique en partie par la mondialisation et par la fin de la guerre froide. Mais, si l’on se focalise sur ces processus structurels et sur les réactions qu’ils ont entraînées de la part de la ‘communauté internationale’, on risque de laisser dans l’ombre les intérêts nationaux et les enjeux de pouvoir à l’œuvre derrière l’instauration de dispositifs répressifs à l’échelle mondiale. De plus, on ne saurait évaluer l’harmonisation mondiale des législations sans tenir compte des difficultés et des divergences que manifeste sa mise en œuvre au plan national. À partir des exemples français et allemand, cet article étudie le rôle des États en tant que producteurs et utilisateurs du droit international incriminant le blanchiment d’argent et la corruption d’agents publics étrangers. |

| Summary, etc. | Since the 1990s, international initiatives have lead to a world-wide criminalisation of money laundering and the corruption of foreign officials. Globalisation and the end of the Cold War can explain parts of this new activism against transnational crime. But a focus on such structural processes and the « international community’s» response to them tends to overlook the national interests and power struggles that lie behind the establishment of global prohibition regimes. Moreover, assessments of global legal harmonisation need to be contrasted with the difficulties and divergences of national implementation. Taking France and Germany as examples, this article explores the roles of states as both makers and takers of international law against money laundering and the corruption of foreign officials. |
