Summary, etc. | L’émergence de l’État nation en Europe à l’aube de l’époque moderne s’accompagna d’un contrôle strict du comportement sexuel et de l’apparition d’une interdépendance étroite entre régulation de la sexualité, reproduction et mariage hétérosexuel. Les armées européennes devinrent un champ d’expérimentation pour la création d’hommes et de citoyens modèles; la sexualité des soldats était strictement contrôlée et toute déviation par rapport à la norme sévèrement punie. Le droit militaire, basé sur le droit naturel, sur le concept de guerre juste et sur une certaine idée de la discipline, fut le premier à développer une approche systématique des agressions sexuelles, à les hiérarchiser et à trouver les moyens de les punir. Le résultat fut que les codes et les tribunaux militaires européens condamnaient toute pratique sexuelle s’écartant de la norme, c’est-à-dire des relations conjugales hétérosexuelles vouées à la reproduction. Ce fut l’un des aspects les plus importants de l’émergence et du développement de l’État nation. |

Summary, etc. | The emergence of the nation state in early modern Europe was associated with firm policing of sexual behaviour and the creation of a close interdependence between permitted sexuality, procreation, and heterosexual marital union. European armies became experimental fields for the creation of model men and citizens; their sexuality was tightly controlled, and any deviation from the norm harshly punished. Military law, based on the school of natural law and the concept of a just war and military discipline, was the first to develop a systematic approach to sex offences, their hierarchies, and forms of punishment. As a result, European military codes and military courts prosecuted any sexual practices which deviated from the norm (interpreted as procreative marital heterosexual relations). This was one of the most important aspects of early modern development and the emergence of the nation state. |
