| Summary, etc. | La marginalisation de la Cour pénale internationale dans la lutte contre le terrorisme international et face à l’écrasement des révolutions démocratiques dans le monde arabe semble mettre définitivement à bas l’idéal de la Paix par le droit inauguré à Nuremberg. Pourtant, de rédempteur à transformateur, le sens de cette justice peut être reconsidéré sans perdre ses fondamentaux (sanction, prévention, réparation). En dépit de l’intensification des oppositions extérieures (de la part de grandes puissances) et des tensions internes (à l’Assemblée des États parties ou au sein de la Cour elle-même), et du manque de moyens, elle dispose de ressources internes pour améliorer son efficacité et développer de nouvelles formes de rendre justice. Le devoir d’imagination des héritiers de la justice pénale internationale n’est pas moins grand et ardu que celui de ses pionniers. |

| Summary, etc. | The marginalization of the International Criminal Court in fighting international terrorism and in the wake of the crushing of the democratic revolutions in the Arab world seems to definitively put an end to the ideal of Peace through law that was inaugurated in Nuremberg. Yet, from redeeming to transforming, the meaning of this justice may well be reconsidered without losing its fundamentals (sanction, prevention, reparation). Despite the intensification of contrasting actors (the major geopolitical powers) and internal tensions (at the Assembly of States Parties or within the Court itself), and the lack of resources, it has the inner resources to improve its effectiveness and develop new forms of justice. Thus, the duty to imagine the future of international criminal justice is no less grand and challenging for its heirs today than it was for its pioneers. |

| Summary, etc. | La marginalización de la Corte Penal Internacional en la lucha contra el terrorismo internacional y frente al aplastamiento de las revoluciones democráticas en el mundo árabe parece haber acabado definitivamente con el ideal de la Paz a través del Derecho inaugurado en Núremberg. Sin embargo, cabe revisar el sentido de esta justicia, de redentora a transformadora, sin perder sus fundamentos (sanción, prevención, reparación). A pesar de la intensificación de la oposición exterior (por parte de las grandes potencias) y de las tensiones internas (en la asamblea de Estados Partes o en el seno de la propia Corte), y de la falta de medios, dispone de recursos internos para mejorar su eficacia y desarrollar nuevas formas de impartir justicia. El deber de imaginación de los herederos de la justicia penal internacional no es menor ni menos arduo que el de sus pioneros. |
