| Summary, etc. | Faute de se prévaloir du droit des peuples à disposer d’eux-mêmes, les nations sans Etat opposent à la légitimité démocratique du constitutionnalisme libéral une légitimité historique fondée sur la permanence d’une identité forgée au fil du temps. Le problème politique et juridique soulevé par la revendication des nations sans Etat ne peut trouver sa solution que dans le cadre existant de la Constitution libérale positive. Or, ce cadre constitutionnel tel qu’interprété par le juge constitutionnel, peut s’avérer plus ou moins flexible (Canada, Ecosse), mais aussi particulièrement intangible (Espagne). Dans ce dernier cas, il tend à renforcer le présupposé historiciste des nations sans Etat. |

| Summary, etc. | For lack of taking advantage of the right of peoples to self-determination, nations without State set against the democratic legitimacy of the liberal constitutionalism a historic legitimacy based on the permanence of an identity forged over time. The political and legal problem raised by the demand of nations without State can find its solution only in the existing frame of the positive liberal Constitution. This constitutional frame such as interpreted by the constitutional judge, can turn out more or less flexible (Canada, Scotland), but also particularly inviolable (Spain). In this last case, it tends to strengthen the historicist presupposition of the nations without State. |
