| Summary, etc. | La conception et la mise en œuvre des soins psychiques auprès d’adolescents sous-main de justice posent certaines questions d’ordre éthique et pratique pour les professionnels, notamment pour les psychologues cliniciens qui contribuent à leur prise en charge institutionnelle. Notre propos prendra principalement appui sur la pratique clinique à la Protection Judiciaire de la Jeunesse dans les « hébergements » pour adolescent(e)s placés sous autorité judiciaire dans un cadre pénal. En alternative à l’incarcération, la mesure de placement provisoire en institution (ré)éducative est alors ordonnée par un mandat judiciaire. Cette mesure peut être accompagnée d’un certain nombre d’obligations, dont l’obligation de soin. Mais comment le soin psychique peut-il s’opérer pour ces adolescents au regard de leurs caractéristiques psychopathologiques ? Le processus soignant peut-il être contraint par un tiers ou prend-il plutôt appui sur l’autorité judiciaire pour devenir opérant ? |

| Summary, etc. | The conception and implementation of psychological care for adolescents under judicial authority raise certain ethical and practical questions for professionals, particularly for clinical psychologists who contribute to their institutional care. Our discussion will be based mainly on clinical practice in the Youth Judicial Protection in “accommodation” for adolescents placed under judicial authority in a penal context. As an alternative to incarceration, the measure of temporary placement in a (re)educational institution is then ordered by a judicial mandate. This measure may be accompanied by a certain number of obligations, including the obligation to provide care. But how can psychological care be provided for these adolescents in view of their psychopathological characteristics? Can the care process be forced by a third party or does it rather rely on the judicial authority? |
