Nous examinons ici cette question à travers le traitement judiciaire d’un crime – une situation d’inceste – lors d’une session en Cour d’Assises. Notre hypothèse est que, par le déroulé de la session d’assises, s’institue un méta-système créant une synchronisation de l’ensemble des sous-systèmes dont ceux de soin et de protection. C’est à partir de la rencontre clinique avec Sophie en institution pédopsychiatrique, puis du procès en Cour d’assises de son agresseur auquel nous avons assisté dans le cadre de notre formation systémique, que nous déploierons notre argumentation. |

| Summary, etc. | When the course of care meets the judicial field: a therapeutic meta-system?How to integrate the dimension of the penal intervention in a therapeutic perspective? We try to answer to this question by observing the judicial treatment in a trial of a situation of incest. Our hypothesis is that the court session establishes a meta-system which create a synchronization of all the subsystems, in particular the curative and protective subsystems. We will use to support our point of view the clinical encounter with Sophie when she was hospitalized in child psychiatry, followed by the opportunity given during our systemic training, to assist at the trial of her sexual abuser. |
