| Summary, etc. | Le développement contemporain des nouvelles technologies de l’information et de la communication dans les entreprises a induit une redéfinition des flux d’information intra ou extra entreprises qui s’est parfois traduit par la création de méthodes économiques dont la protection a été recherchée dans le brevet. Les méthodes économiques sont, en pratique, jusqu’à présent largement brevetables aux États-Unis bien que le champ d’application du brevet tende à leur être plus difficilement accessible alors qu’en Europe, et dans une moindre mesure en France, le mouvement inverse semble se produire, notamment à la faveur de la proposition de directive communautaire sur la brevetabilité des inventions mise en œuvre par ordinateur. L’opportunité de la brevetabilité des méthodes économiques doit être appréciée en considération du fondement du brevet qui impose que l’inconvénient temporaire pour la société qui résulte du privilège concurrentiel accordé au propriétaire du brevet sur son invention doit être inférieur au bénéfice que la société retire de la divulgation de cette invention consistant en l’enrichissement de son patrimoine technologique. |

| Summary, etc. | The contemporary development of information and communication new technologies in companies entailed a redefinition of internal or external information flows that has sometimes been embodied in the creation of economic methods which protection was searched in patent. In practice, economic methods are so far largely patentable in the United States although the field of patent tends towards to be less accessible whereas in Europe, and to a lesser extent in France, the opposite movement seems to occur, in particular with the European proposal for a directive on the patentability of the computer- implemented inventions. The opportunity of the patentability of economic methods must be appreciated in consideration of the base of patent according to which the temporary disadvantage for the society that results from the competing privilege granted to the owner of the patent on his invention must be lower than the benefit that the society obtains from the disclosure of this invention consisting of the enrichment of its technological patrimony. |
