| Summary, etc. | Introduite par Warren et Brandeis, la notion de droit au respect de la vie privée (ou « privacy ») est parvenue aujourd’hui à la reconnaissance dans de nombreux systèmes juridiques. L’explosion de la privacy, pendant la dernière décennie, peut être expliquée par l’histoire de la circulation précoce de ce concept. Il est beaucoup plus difficile de parler d’un concept commun et de le définir. La privacy ne peut être décrite comme un espace déterminé avec un contenu précis. C’est plutôt une limite, fixée par le juge, pour empêcher les ingérences dans une liberté individuelle. En tant que frontière, la privacy remplit une fonction pour trancher des cas litigieux et peut être facilement transférée d’un ordre juridique à un autre. |

| Summary, etc. | Introduced by Warren and Brandeis in 1890, the notion of a right to privacy has succeeded in being recognized by many legal systems today. The surge of privacy cases during the past decade can be explained by the history of the early circulation of this concept. It is more difficult to speak of a common concept and to define it. Privacy cannot be depicted as a determined space with a precise content. Privacy is rather a border-line, set by the judge, to prevent interferences with an individual freedom. As a frontier, privacy fulfils a function in deciding litigious cases and this function can be easily transposed from one legal order to another. |
