| Summary, etc. | Cet article est issu d’une intervention donnée à l’occasion de la parution du n° 100 de Droit et Société, autour de l’article « After Legal Consciousness Studies » de Susan Silbey. En comparant les réceptions, au Japon et en France, de cette étude américaine sur la conscience juridique, on remarque trois points. Premièrement, alors qu’en France, il est reçu comme relevant de la tradition du « droit social » et qu’on tente de le lier à l’étude de la mobilisation du droit, au Japon, on le voit comme un courant postmoderne et peut être lié à la création d’un mode alternatif de résolution des conflits. Deuxièmement, au Japon – pays qui a dû se moderniser en important les droits occidentaux, on pensait qu’il existait un décalage entre la conscience juridique des Japonais et l’esprit du droit moderne, si bien que les études qualitatives et quantitatives sur cette conscience juridique étaient considérées comme complémentaires. Troisièmement, en nous référant au concept de légalité de Weber, nous étudierons la conscience juridique dans une perspective plus globale et historique. |

| Summary, etc. | This article is the result of a talk given on the occasion of the publication of the n° 100 of Droit et Société, about the article “After Legal Consciousness Studies” by Susan Silbey. We compare the reception of the American study of legal consciousness in Japan and France, and note three points. First, the article was deemed relevant to France’s social law tradition and it tries to link it to the study of the legal mobilization. In Japan, it was associated with a postmodern trend and linked to the creation of an alternative mode of dispute resolution. Second, Japan imported Western law for modernization and it was thought that there was a mismatch between the legal consciousness of the Japanese and the idea of modern law, so that qualitative and quantitative studies of legal consciousness were considered complementary. Third, if we refer to Weber’s concept of legality, we will be able to study legal consciousness from a more global and historical perspective. |
