| Summary, etc. | Résumé Cet article a pour but d’analyser les conditions de l’apparition des mouvements de « critique du droit » au Brésil pendant les années 1990. Il met l’accent sur deux espaces de production et d’usage du droit : l’espace universitaire et l’espace des carrières juridiques « pratiques ». La double légitimation de la « critique du droit », construite contre la tradition juridique brésilienne, est le produit d’une correspondance étroite entre un espace producteur de nouvelles définitions du droit et un espace de mobilisation de ces définitions en vue de fonder des usages du pouvoir judiciaire. En ce sens, celle-ci peut être vue comme un processus lié au repositionnement des juristes dans l’espace de pouvoir au Brésil. De la même manière, un tel phénomène s’intègre dans le cadre des changements de la conjoncture politique du pays. |

| Summary, etc. | Abstract Diversification of Legal Space and “Critical Legal Studies” in Brazil in the ’90sThis paper analyzes the determinants of the movement of “Critical Legal Studies” emerging in Brazil in the ’90s. It focuses on two spaces of law production and use : academia and “practical” legal careers. The double legitimation of “Critical Legal Studies”, constructed in opposition to the Brazilian legal tradition, occurs in the narrow correspondence between a space producing new legal definitions and a space of mobilization of these definitions to establish the uses of judicial power. In this sense, it can be read as a process linked to the relocation of the jurists in the sphere of power in Brazil. Such a phenomenon integrates itself in the alterations in the politics conjuncture of the country. |
