| Summary, etc. | Résumé Cet article s’appuie sur une recherche consacrée au traitement des réclamations dans les caisses d’allocations familiales. Elle montre que les caisses qui se sont organisées localement pour améliorer a pr i ori les modalités d’application du droit sont également celles où le nombre de recours au juge est le plus important, favorisant ainsi un contrôle a posteriori de l’application du droit. Ce constat est logique si l’on conçoit le débat judiciaire comme un espace concurrent à l’organisation pour fixer les situations individuelles et déterminer le sens de la règle. Dans cette perspective, une organisation qui souhaite préserver un usage monopolistique du droit évite la controverse, que ce soit dans ses services ou devant un tribunal. |

| Summary, etc. | Abstract The Power of the Organization : Controlling Legal Resources in the Family Division of the Social Security OfficeThis article is based on the analysis of claims processed by the French Social Security Office [ Caisses d’allocations familiales (CAF)]. It shows that the CAFs organized locally to improve the implementation of the law also have the best recourse to judges, thus facilitating an a post e riori control of the law’s application. This is logical if the judicial debate is conceived as a space competing with the organization to determinate individual situations and the meaning of the rule. Indeed, an organization wishing to preserve a monopolistic use of the law will prefer to avoid controversy in the organization itself and in court. |
