| Summary, etc. | Résumé La prison constitue un lieu d’exception aux normes de l’État de droit : une grave anomalie, voire un démenti à ses prétentions. La conformité du système carcéral à ce modèle comme la qualité de celui-ci sont en tout cas objets de dispute, invitant à examiner les conditions sociales requises pour que l’autorité politique passe pour un État de droit à l’aune de ses prisons. Or, les définitions classiques n’épuisent pas les critères sur lesquels les acteurs se fondent pour appuyer leurs jugements. Des exemples allemands, mais ayant une portée générale, montrent que la matérialité inhérente au dispositif carcéral appelle un critère d’évaluation physique (architecture, technologie) nécessairement convoqué pour évaluer le respect des prétentions carcérales du Rec h tsstaat |

| Summary, etc. | Abstract In a state ruled by law, the prison system is nonetheless a social space of normative exception and it can bring the whole State into disrepute. The conformity of punishment practises to this model remains a matter of controversy. This article studies the very definition of the Rechtsstaat vis-à-vis its prisons. Yet, classical legal approaches do not exhaust all the criteria used by the social actors to ground their judgments. Steeped in German prison history, this article shows that given the intrinsic materiality of prison design, the definition of the Rechts staat depends not only on rules, procedures, and institutions, but also on architectural and technological criteria. |
