| Summary, etc. | RésuméLe développement de l’intérim en France a souvent été analysé comme un effet de sa réglementation, qui autorise les entreprises à en faire usage et les agences d’intérim à le commercialiser. Cependant ces droits ont été assortis de contraintes qui rendent a priori difficiles les échanges entre agence, entreprises et travailleurs. Pour comprendre comment ils ont pu coopérer, cet article propose une étude de leurs usages quotidiens de toutes ces règles, permissives et restrictives, adossée à une analyse stratégique et systémique. Il révèle des mécanismes d’instrumentalisation et de managérialisation du droit. Il montre aussi comment ce droit restrictif a permis de consolider la position des agences. Des contraintes réglementaires peuvent ainsi être les conditions de l’action et des échanges. |

| Summary, etc. | The development of temporary agency work in France has often been analyzed as a result of its regulation, which allows companies to use it and temporary work agencies to market it. However, these rights have been added to constraints that encumber exchanges between agencies, companies, and workers. To understand how they could cooperate, this article puts forward a strategic and systemic analysis of the social uses of these permissive and restrictive rules. The study reveals both the mechanisms of the law’s instrumentalization and managerialization and how this restrictive law has allowed agencies to consolidate their position. Legal constraints can thus be the conditions of action and exchanges. |
