| Summary, etc. | L’article qui suit s’interroge avec Axel Honneth sur la manière dont le droit peut satisfaire aux demandes de reconnaissance de l'identité personnelle. Y est d’abord exposée la réflexion qu’a menée Honneth sur le rôle de la reconnaissance dans la construction de l'identité personnelle en se basant sur certains développements récents dans les domaines de la psychologie et de la psychanalyse. Suit une présentation des thèses de ce même auteur sur l’intervention du droit dans la distribution de la reconnaissance. L’article relève la manière dont une certaine « focalisation paradigmatique » conduit Honneth à élaborer une théorie normative sur la base de la seule société « moderne ». Néanmoins, en restituant l’intime relation entre la théorie du droit, d’une part, et la psychanalyse et la psychologie, de l’autre, le concept honnéthien de reconnaissance demeure un important outil théorique de critique sociale. |

| Summary, etc. | Recognition: Law Faced with Personal Identity The present essay discusses how law can satisfy demands for recognition of personal identity. First discussed are Honneth’s reflections on the role recognition plays in the construction of personal identity, reflections fueled by recent developments in psychology and psychoanalysis. This is followed by an analysis of the Honnethian model as it pertains to the intervention of law in the distribution of recognition. Unfortunately, Honneth’s “paradigmatic over-focusing” leads him to develop a normative theory based on “modern society” only. Nonetheless, by unveiling the intimate connection between legal theory and psychoanalysis, “recognition” as conceived of by Honneth proves a powerful theoretical tool for social critique. |
