| Summary, etc. | Le débat sur la réforme pénitentiaire est permanent. Il s’est cependant fortement cristallisé ces derniers mois sur la conjoncture législative, la loi pénitentiaire n? 2009-1436 du 24 novembre 2009 ayant concentré la plupart des analyses. Si, incontestablement, l’adoption de cette loi constitue symboliquement un moment essentiel dans l’évolution du service public pénitentiaire – et pas seulement de la prison qui n’en est que l’une des manifestations –, elle ne saurait cependant l’absorber complètement, ne serait-ce que parce qu’elle prend place dans des dynamiques de changement plus structurelles dont elle n’est que l’une des expressions. Si elle constitue un fil conducteur de cette étude, c’est moins pour en faire une analyse en soi que pour mesurer en quoi elle traduit, ou non, des évolutions plus substantielles de notre rapport à la prison et à l’administration qui est chargée de la gérer. |

| Summary, etc. | Penitentiary Reform: Timeless Debates, Cyclical Changes Debate about penitentiary reform in France is ongoing. It has nonetheless crystalized recently over the legislative climate, specifically the penitentiary law (2009-1436) of November 24, 2009. If the adoption of this law incontestably symbolizes an essential point in the evolution of the French penal system, it does not finalize reform. While this law is at the center of this study, its analysis is not. Instead, this article measures how the law translates – or not – into more substantial changes in society’s relationship to the penitentiary system. |
