Summary, etc. | RésuméLa subsidiarité juridictionnelle, qui a été instituée dès l’origine dans la Communauté européenne, a pour objet de confier aux juges nationaux la responsabilité de veiller à la bonne application du droit communautaire dans les ordres juridiques internes. Il est intéressant de s’interroger sur le rôle de cette subsidiarité dans l’intégration européenne. L’observation de ce phénomène permet de constater que la subsidiarité juridictionnelle, loin d’être une entrave au processus d’intégration, a au contraire participé à son avancée. Des exemples tirés de différentes jurisprudences nationales illustrent les paradoxes qui affectent la position du juge interne ainsi que l’évolution de son rôle au fil du temps. Il apparaît au bout du compte que les juges interne et européen ont fait taire une grande partie de leurs oppositions initiales pour parvenir à des compromis. |

Summary, etc. | European Integration by Means of “Jurisdictional Subsidiarity”?Jurisdictional subsidiarity, which was introduced into the European Community at its inception, entrusts the national judges with the proper application of European law in the member states. This article deals with the role of subsidiarity in European integration. We can observe that the jurisdictional subsidiarity, far from being an obstacle to this integration, is, in fact, favorable to its evolution. Some examples of national jurisprudence show the paradoxes in the national judges’ position, as well as the evolution of their role over time. In the end, it appears that the national and European judges have overcome most of their initial opposition, have reached a compromise, and tend to share common goals: the “war of the judges” is being replaced by a “Europe of the judges.” |
