Summary, etc. | À partir d’une enquête de terrain effectuée dans cinq villes canadiennes entre 2008 et 2011, cet article propose une analyse des représentations et des discours tenus par des juges et des procureurs sur l’itinérance et en particulier sur la légitimité d’avoir recours en la matière à la répression pénale et à la judiciarisation. Y sont présentés trois modèles de justice qui se dégagent de l’articulation entre ces représentations et ces discours. En se fondant sur la notion de violence symbolique empruntée à Bourdieu, cet article pose aussi la question de l’autorité et de l’hégémonie du système de justice pénale comme mode de gestion des conflits liés à l’itinérance ainsi que celle des liens étroits qu’il entretient avec la reproduction des inégalités sociales dans un État néolibéral. |

Summary, etc. | From Criminal to Social Justice: An Analysis of Legitimating Discourses in the Judicialization of Homelessness in CanadaBased on extensive fieldwork conducted in five Canadian cities between 2008 and 2011, this article proposes an analysis of the different representations and discourses held by judges and prosecutors with respect to homelessness and in particular, with respect to the legitimacy of using the criminal justice system to deal with homelessness. Relying on such judicial representations and discourses, the article presents three possible configurations or models of doing justice. Using Bourdieu’s theory of symbolic violence, it ultimately addresses the issue of how the criminal justice system succeeds in maintaining its authority and hegemony as a conflict resolution system as well as its role in reproducing social inequalities in a neoliberal state. |
