Summary, etc. | Au Québec, la Loi sur les normes du travail reconnaît le droit de la personne salariée à un milieu de travail exempt de harcèlement psychologique. Le recours de la personne syndiquée est le dépôt d’un grief. La lecture des décisions arbitrales révèle un langage parfois plus psychologique que juridique, surtout associé au rejet des griefs. Ce langage traduit un regard sévère sur les personnes qui portent plainte, faisant porter l’enquête sur le caractère « normal » de leur personnalité et la présence d’une maladie mentale chez elles. La tendance à une lecture psychologisante des griefs pour harcèlement a pour effet d’écarter l’analyse sociale et organisationnelle des milieux de travail. L’intention du législateur était pourtant d’assainir les milieux de travail par un examen critique de l’organisation du travail et de l’exercice du droit de gérance. |

Summary, etc. | Psychological Harassment at Work: Between Psychologization and VictimizationThe Québec Labour Standards Act provides that every worker has a right to a work environment free from psychological harassment. A unionized worker’s recourse lies with grievance arbitration. Analysis of arbitration decisions reveals language that is often more psychological in nature than legal, especially when associated with the denial of a grievance. Arbitrators take a harsh view of complainants, directing inquiry as to whether their personality is “normal” and whether they have a mental illness. The tendency towards a psychological reading of harassment grievances effectively displaces social and organisational analysis of workplaces, even though legislative intention was to make workplaces healthier through a critical examination of work organization and exercise of management prerogatives. |
