Summary, etc. | RésuméAu moment où il s’autorisait à contrôler la loi telle qu’elle est effectivement appliquée (décisions 2010-39 et 2010-52 QPC), le Conseil constitutionnel s’est fondé sur la distinction entre le travail interprétatif et le résultat de l’interprétation pour se défendre d’empiéter sur le travail du juge ordinaire. L’argument paraît pourtant, du point de vue théorique, fragile : cet article entend montrer que si son champ d’action a été, de fait, restreint, ce n’était pas la conséquence d’une obligation logique. En étudiant la pratique déjà existante du Conseil constitutionnel, on peut avancer que le self-restraint dont il a fait preuve est plutôt la conséquence de contraintes stratégiques, dues notamment à la nouveauté que représente un contrôle a posteriori de la loi dans un paysage judiciaire qui n’organise pas de hiérarchie entre les trois plus hautes cours. |

Summary, etc. | When the Constitutional Council allowed itself to examine laws according to how they are effectively enforced (QPC 2010-39 and 2010-52), it relied on a distinction between the interpretive work and the results of interpretation to defend criticism that it was encroaching on the role of ordinary judges. From a theoretical point of view, this argument appears to be fragile. This article argues that the restraint with which it has been employed to date does not follow logically. By examining the Constitutional Council’s prior practices, one may propose that its self-restraint derives mainly from the strategic constraints arising from its novel role in examining laws post-hoc, in a judicial landscape with no hierarchy amongst the three highest courts. |
