| Summary, etc. | De l’avis des transhumanistes, l’humanité serait en « transit » : alors qu’on la pensait « finie », il serait nécessaire de la parfaire. Dans ce contexte et face aux dérives scientistes, les droits de l’homme sont souvent convoqués. Reposant sur une philosophie individualiste et ayant pour finalité la garantie des libertés, ces droits montrent, toutefois, leurs limites ; ils sont d’ailleurs revendiqués par les mouvements transhumanistes eux-mêmes. Face à l’émergence d’une posthumanité, les droits de l’homme, fondés sur la nature humaine, peinent à maintenir l’égalité de tous qui constitue leur principe premier. Il devient alors nécessaire de consacrer une nouvelle catégorie juridique : celle des droits de l’humanité, droits déjà en germe dans l’ordre juridique international. Le but est d’affirmer ainsi la dignité de la famille humaine.Pour autant, il convient de se garder d’une approche absolutiste de la dignité comme de l’humanité : une hiérarchie préétablie entre droits de l’homme et droits de l’humanité doit être écartée considérant que tout droit n’est qu’un commencement de droit, susceptible de s’incliner en cas de conflit avec un autre droit. |

| Summary, etc. | According to transhumanists, humankind would be in “transit”: whereas it was believed to be “finished”, it would be necessary to perfect it. In this context and facing scientism, human rights are often invoked. However, these rights, based on an individualist philosophy and designed to guarantee freedoms, show their limits; they are, by the way, claimed by the transhumanist movements themselves. Faced with the emergence of posthumanity, human rights, based on human nature, struggle to maintain the equality of all that constitutes their primary principle. That’s why it is now necessary to recognize a new legal category: the rights of mankind; these rights are already embryonic in the international legal order. The dignity of the human family must be affirmed. Nevertheless, an absolutist approach of dignity and humankind have to be banished: a pre-established hierarchy between human rights and rights of mankind must be ruled out, considering that every right is only the beginning of a right and it may bow in the event of a conflict with an other right. |
