| Summary, etc. | Where do we stand regarding the right to bear children from an ethical or philosophical standpoint ? Two opposite assumptions emerge, a deontological assumption, and a teleological one. The principles of inviolability of a person and non-commercialization of the human body are at stake. Medical indications justifying legally resorting to surrogacy are extremely rare. Non-medical indications could be extended as a result of authorizing women couples to access any type of Assisted Reproductive Technology. There are many unforeseen uncertainties involved in the supposed “generosity” that is invoked when resorting to surrogacy, if only the issue of the child’s psycho emotional balance. Filiation risks becoming a marginal makeshift made up of objective and subjective rights. Social pressures are huge in this area. Irène Théry’s recent report is a plea for a better understanding of multi parent families. A philosophical examination of the notion of personal identity seems an indispensable preliminary exercise. |
