| Summary, etc. | As a recently created institution, the Prudential Supervisory Authority (ACP ? Autorité de contrôle prudentiel) enjoys a legal status and sufficient means to guarantee its organic and operational independence with respect to the regulated sectors and the executive. Therefore, although it does not have legal personality, it has budgetary autonomy and some flexibility in human resources management. Furthermore, whereas independence from government is one purpose of independent administrative authorities, the same cannot be said of Parliament, which can impose a ceiling on employment authorizations for the ACP. However, Parliament has no authority to set prudential rules and must rely on complex soft-law mechanisms such as recommendations. |
