Summary, etc. | This article demonstrates the substantial complementarity between “legal solidarity” and “engagement solidarity” through the example of the two collective complaints introduced in the framework of the Additional Protocol to the European Social Charter. The article shows the process by which international nongovernmental organizations (INGOs) brought state policy into line with the Revised European Social Charter of the Council of Europe. We focus on two collective complaints addressed by the European Committee for Home-Based Priority Action for the Child and the Family (EUROCEF): one concerning the suspension of family allowances in the case of school absenteeism, according to the laws of September 28, 2010, and March 24, 2011 (both currently repealed); and another, more recent, showing that France does not fulfill its commitments with regard to unaccompanied foreign minors staying on its territory. The article encourages reflection on the possible use of the complaints procedure in the field of social work through its civil society sector. |
