| Summary, etc. | RésuméL’enfant dont les parents se séparent ou sont en désaccord sur des points essentiels de son éducation a le droit d’être entendu par le juge aux affaires familiales avant que celui-ci ne tranche le litige. Ce droit, reconnu depuis 1993, a été développé par la loi du 5 mars 2007 réformant la protection de l’enfance. L’exercice concret de ce droit soulève de nombreuses questions : comment le discernement de l’enfant est-il analysé ? Quel poids est donné à ses demandes et comment les adultes peuvent-ils garder leur rôle de responsable de la décision prise ? Le juge doit-il l’entendre directement ou déléguer un professionnel ? Quel est le rôle de l’avocat qui peut assister l’enfant ? Les juges aux affaires familiales confrontés à l’exercice de ce droit ont adopté des pratiques diverses. À Libourne, une convention entre les juges et les avocats a été adoptée afin de permettre la prise en compte systématique de l’opinion de l’enfant, directement ou par l’intermédiaire de son avocat, en évitant de le placer dans une situation inconfortable, voire traumatisante. L’évaluation de sa mise en œuvre est encourageante tant du point de vue des professionnels que des parents et des enfants. |

| Summary, etc. | Children whose parents are parting or disagree on crucial educational points have the right to go before the judge for Family affairs prior to the dispute settlement. This right, acknowledged since 1993, has been enhanced by the Act of March 5, 2007 reforming children’s protection. The enforcement of this specific right raises many concerns :How should the child’s discernment be analysed ?What should be the importance given to his requests and how could adults play their role as responsible of the judge’s decision ?Should the judge meet the child personally or should he assign some other professional ?What should be the role of the lawyer assisting the child ? |
