| Summary, etc. | Cet article présente les étapes et les enjeux d’une politisation de la question animale. Il s’agit d’abord de savoir de quoi l’on parle quand on fait référence aux droits des animaux. La protection de leurs droits de base et de leur inviolabilité a des implications pratiques considérables, mais elle ne suffit pas à déterminer nos obligations concrètes à l’égard des animaux. Une théorie relationnelle du droit est nécessaire pour comprendre comment il est possible d’intégrer les intérêts subjectifs des animaux dans la définition du bien commun. C’est à ce travail, qui suppose que le problème politique ne se réduit pas à la coexistence pacifique des libertés et des intérêts des hommes actuels, que nous nous attachons, esquissant les contours de ce que pourrait être un contrat social faisant de l’amélioration de la condition animale un devoir de l’Etat. |

| Summary, etc. | Zoopolitics and Justice for AnimalsThis article presents the stages and stakes at play in the politicization of the animal rights question. We will first examine what we are speaking of exactly when we make reference to this question. The protection of animals’ basic rights and immunity has considerable practical implications, but does not suffice to determine our concrete obligations towards them. A relational theory regarding the law is necessary if we are to understand how the subjective interests of animals may be integrated into how we define the common good. That is the underlying aim of this research, and it presupposes that the problematical political nature of this question should not be reduced to the mere peaceful coexistence of the liberties and interests of people in modern-day society. This leads us to trace the outlines of what could become a new social contract, by which improving the animal condition would become a duty of the State. |
