| Summary, etc. | RésuméL’analyse de la situation juridique de la satire et de la caricature en Allemagne et l’étude de quelques décisions de justice permettent de mesurer à quel point le législateur éprouve des difficultés à définir ces deux genres et à établir une législation claire. Le nombre de procès évolue en fonction des époques et tend à s’accroître ces dernières années, en raison des nombreuses plaintes déposées par des particuliers. Ces données juridiques se révèlent toutefois insuffisantes pour saisir le contexte global dans lequel sont produites et reçues les créations satiriques. Les satiristes et les dessinateurs allemands doivent tenir compte des seuils de tolérance de l’opinion allemande face à la virulence graphique et se soumettre, de leur plein gré ou non, à une autocensure généralement bien plus sévère qu’en France. |

| Summary, etc. | The analysis of the legal status of satire and satirical cartoon in Germany as well as the study of some court decisions enable us to size up the legislator’s difficulties in defining these two genres and in establishing a clear legislation. The number of court actions varies in time and shows an increase in recent years owing to the number of private complaints. These juridical data do not enable us, however, to apprehend the global context in which these complaints are lodged and these satirical creations produced and received. German satirists and cartoonists must take into account the tolerance threshold of German public opinion regarding graphical virulence and must willy-nilly consent to a self-censorship that is generally more severe than in France. |

| Summary, etc. | ZusammenfassungDie Analyse der rechtlichen Lage von Satire und Karikatur in Deutschland sowie die Untersuchung einiger Gerichtsentscheidungen lassen die Schwierigkeiten des Gesetzgebers erkennen, diese beiden Genres zu definieren und eine klare Gesetzgebung zu etablieren. Die Zahl der Prozesse wandelt sich mit den Epochen und nimmt in den letzten Jahren aufgrund zahlreicher Privatklagen immer mehr zu. Diese juristischen Daten erweisen sich jedoch als unzureichend, um den allgemeinen Kontext der Produktion und Rezeption von Satire zu begreifen. Deutsche Satiriker und Zeichner müssen die Toleranzschwelle der deutschen Öffentlichkeit bezüglich der Agressivität von Zeichnungen berücksichtigen und sich wohl oder übel einer Selbstzensur unterwerfen, die viel strenger als in Frankreich ist. |
