| Summary, etc. | RésuméCet article se présente comme un dialogue entre un juriste et un ethnologue, débattant du traitement du risque sportif. Comment le droit aborde-t-il cette question au regard de l’évolution de la pratique sportive et des normes juridiques qui visent à déterminer les responsabilités et la prise en charge du dommage ? En retenant plutôt le respect des « règles du jeu » de chaque discipline sportive, le droit semble ne pas faire de l’acceptation du risque un critère juridique valable. Cela tient en partie au fait que la charge du risque se voit progressivement déplacée de l’individu vers le groupe – telle l’association sportive. Mais alors, qu’en est-il de l’exercice du libre arbitre des individus et de la responsabilité qui en résulte ? |

| Summary, etc. | This article is conceived as a dialogue between a jurist and an ethnologist about the treatment of risk in sport. It shows how the law treats the question in the face of the evolution of sports practice and of juridical norms aiming at determining the responsibilities and taking care of the injury. By taking more into account the respect for the « rules of game » in each sport discipline, the law seems to consider risk acceptation as a non valid juridical criterion. This is partly due to the fact that the charge of risk is progressively shifted from the individuum to the group – such as the sports association. But then, what about the exercise of the free will of individuums and the resulting responsability ? |

| Summary, etc. | ZusammenfassungDieser Artikel wird als ein Dialog zwischen einem Jurist und einem Ethnologen über die Behandlung des Risikos im Sport gefasst. Er zeigt wie das Recht diese Frage angesichts der Entwicklung der Sportpraxis und der rechtlichen Normen behandelt, die dazu zielen, die Verantwortlichkeiten und die Berücksichtigung der Schaden zu bestimmen. Durch die Beachtung der « Spielregeln » in jeder Sportdisziplin scheint das Recht die Risikoakkzeptation nicht als rechtverbindliches Rechtskriterion zu nehmen. Dies ist zum teil dem Fakt zuzuschreiben, dass die Bürde des Risikos allmählich von dem Individuum auf die Gruppe – wie die Sportsvereinigung – geschoben wird. Aber dann, wie steht es mit der Ausübung des freien Willens der Individuen und der daraus resultierenden Verantwortung ? |
