Cette situation est le fruit de trois trajectoires : dans le Second Empire colonial, la coutume est conçue comme un stigmate justifiant la non‑citoyenneté de l’indigène ; dans l’après‑guerre, associée à la citoyenneté de statut local, elle est soit considérée comme un pis‑aller soit comme un signe d’autonomie. Enfin, en Guyane, la coutume officieuse des Amérindiens et Marrons est le symptôme de l’appartenance à des « peuples indépendants », puis de la citoyenneté de droit commun. |

| Summary, etc. | Citizenship in the French overseas territories is still linked to custom. This situation is the result of three historical evolutions: In the second colonial Empire, custom was used as a stigma to justify the denial of citizenship to native people. During the post‑war period, when it was associated with a type of local citizenship, it was seen either as a lesser evil, or as a sign of autonomy. In French Guiana, the unofficial custom of Amerindian and Maroon peoples implies that they are treated as “independent peoples”, then as common law citizens. |

| Summary, etc. | Das Staatsbürgerrecht in den französischen Überseegebieten wird weiterhin mit der Gewohnheit verbunden. Dieser Zustand ist das Ergebniss drei verschiedener Laufbahnen : im zweiten französischem Kolonialreich,wurde die Gewohnheit als ein Schandfleck empfunden ,der das Nicht‑Staatbürgerecht des Eingeborenen rechtfertigte ; in der Nachkriegszeit des Zweiten Weltkriegs, wurde sie mit dem lokalen Statut des Staatsbürgerechts verbunden ,und wurde entweder als eine Aushilfe oder als ein Zeichen von Selbstverwaltung betrachtet. Schliesslich ist in französisch Guayana die halbamtliche Gewohnheit der einheimischen Indianer und der „Marrons” ein Anzeichen ihrer Zugehörigkeit zu „selbständigen Völker“ und in der Folge zum gemeinen Staatsbürgerrecht. |
